The NSW Environment Protection Authority (NSW EPA) is conducting the “#KeepMeCool Campaign” (Campaign) on the Love Food Hate Waste NSW Facebook page
. By entering the Competition, each entrant agrees to be bound by these terms. .
2. Eligibility and Prize
To be eligible to receive a Love Food Hate Waste fridge thermometer (the prize) entrants must:
a) be New South Wales residents aged18 years or older;
b) complete and submit the digital entry form on the Love Food Hate Waste campaign page (https://www.facebook.com/LoveFoodHateWasteNSW/
) before the closing date
Only one entry per person is eligible.
3. Key Dates
3.1 The closing date to enter the Campaign is 11:59pm AEST on Sunday 31 January 2016.
3.2 The prize will be sent via ordinary mail on Monday 1 February 2016.
4. Notification of Prize
4.1Entrants will be notified by email when the prize is distributed. In this email, entrants may be invited to supply or share an image of themselves for use on the Love Food Hate Waste NSW Facebook Page and the Love Food Hate Waste NSW website (www.lovefoodhatewaste.nsw.gov.au
5. General Rules
5.1 Prizes are not transferable, negotiable, exchangeable or redeemable for cash. NSW EPA takes no responsibility for any variation in the value of the prize or for prizes that are damaged or lost in transit.
5.2 NSW EPA has sole discretion to determine the eligibility of entries and to award the prize. To avoid any doubt, an entry is deemed ineligible if the postal address provided in respect of that entry is not the correct postal address of the entrant. In the event of a dispute, the decision of NSW EPA is final and no correspondence will be entered into.
5.3 If an entrant does not accept any element of a prize, NSW EPA is not obliged to provide that entrant with a substitute prize.
5.4 NSW EPA will own the intellectual property rights in all Campaign entries. Unless authorised by law, NSW EPA may use personal information provided by entrants in connection with the Campaign including names, ages, images or contact details only in connection with the Competition and these terms.
6. Disclaimer and liability
6.1 The Campaign is in no way sponsored, endorsed or administered by Facebook and the entrant agrees to release Facebook from any or all liability in connection with this contest. Queries about the Campaign should be directed directly to NSW EPA.
6.2 NSW EPA accepts no responsibility for invalid, lost or delayed entries, any incorrect or inaccurate information, any equipment or technical error, or for any defect in, theft, destruction, unauthorised access to or alteration of any entry.
6.3 If for any reason, this Campaign is not capable of running as planned NSW EPA reserves the right, in its sole and absolute discretion, take any action that may be available and to cancel, terminate, modify or suspend the Campaign in whole or in part.
6.4 To the extent permitted by law, NSW EPA and the NSW Government will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or indirect) to persons or property as a result of any person entering the Campaign or accepting or using any prize, including without limitation non-receipt of any prize.
6.5 To the extent permitted by law, all warranties in respect of the prize, whether express, implied, statutory or otherwise, are excluded. To the extent such warranties cannot be excluded by law but liability can lawfully be limited, liability is limited at the NSW EPA’s option to replacing the prize or the cost of replacing the prize or acquiring an equivalent item.
6.6 The laws of New South Wales apply to the Campaign to the exclusion of any other law.
A note about how we will manage your Personal Information
Personal information submitted to NSW EPA will be used for the stated purpose of collection i.e. distribution of the prizes. NSW EPA will not use personal or private information for any other purpose without written consent of the owner of personal information except for purposes listed in the Privacy and Personal Information Protection Act 1998 e.g. prevent danger to someone.
Personal information collected by NSW EPA will be stored securely and will be disposed of, according to the Office of Environment and Heritage (OEH) Records Management Policy
